ARTICLES OF PERMISSION AND APPROVAL



发包人应遵守法律，并办理法律规定由其办理的许可、批准或备案，包括但不限于建设用地规划许可证、建设工程规划许可证、建设工程施工许可证、施工所需临时用水、临时用电、中断道路交通、临时占用土地等许可和批准。发包人应协助承包人办理法律规定的有关施工证件和批件。

The employer should abide by the laws and conduct the permission, approval and filing, which are stipulated by laws, include inter alia Planning permission of construction used land, Permission of construction project planning, Permission of project execution, and other permissions or approvals for temporary water, temporary power, interrupt traffic, temporary use land, and so on. The employer should assist the contractor to conduct the licenses and approval documents for construction, which are stipulated by laws.



因发包人原因未能及时办理完毕前述许可、批准或备案，由发包人承担由此增加的费用和（或）延误的工期，并支付承包人合理的利润。

Provided that if failure of completion of the aforesaid permissions, approvals and filings, the added cost and / or delayed term will be undertaken by the employer in addition to the payment of reasonable profit to the contractor.



Permits, Licenses or Approves

The Employer shall (where he is in a position to do so) provide reasonable assistance to the Contractor at the request of the Contractor:

for the Contractor’s applications for any permits, licenses or approvals required by the Laws of the Country:

Together with the Letter of Acceptance, the Employer shall issue to the Contractor the Operating Licence or equivalent legal authorization to enable the Contractor to operate and maintain the Works during the Operation Service Period.

在颁发中标函的同时，业主应向承包商签发运营许可或类似的授权，使承包商在运营服务期能够运营和维护工程。



Necessary permits and licenses for above telephone radio and telex communications equipment for Contractor’s system.

钻井承包商为使用上述通讯设备所需要的许可证和执照。

Necessary permits and licenses for above telephone radio and telex communications equipment for Company’s system.

公司为使用上述通讯设备所需要的许可证和执照。



乙方配合甲方办理施工许可证；

To cooperate with Party B to apply for the construction permit;



业主将从有关部门获取为工厂建造、设备运行所必需的执照和许可证，包括承包商雇员的工作许可证。

The Owner will obtain from the relevant Authorities those licenses and permits necessary to construct and operate the Plant on the Site including work permit for the Contractor’s employees.



安排向C或新公司提供一切必要的条件，包括开发批准、许可、同意、现场转让、使用及其他权利，解决公司注册、进口许可证、关税免除等必需的要求;

the arrangement of the provision of all necessary development approvals，permits，consents，site leases，access and other rights for C or New Company together with the fulfillment of essential requirements such as company egistration，import license and exemption of customs duties and the like;



为C或新公司将资金和盈利(美元)从 ____国带出从 ____有关当局获得一切必要的许可和批准;

obtaining of all necessary permits and approvals from the relevant ____authorities for C or New Company to repatriate capital and dividends in US Dollars from ____;



供应方应承诺其具备充分的资质和能力履行本合同和提供本合同规定的服务，并将获得履行本合同所需的所有及任何许可证及/或其他准证。

Vendor shall undertake that it shall have the full qualification and capacity to execute this Contract and furnish the Services provided hereunder, and will obtain all and any required licenses and/or other permits for the purpose of performance of this Contract.



买方应按适用的Incoterm来为设备的任何部分获得必要的进口许可/证书，并在合适的范围内提供建设许可和生产许可。应卖方要求时，买方应协助卖方获取在安装国履约所必须的安装设备的(临时)进口许可/证书、卖方人员所须的签证/工作许可。

The Purchaser shall obtain import permits and/or licenses required for any part of the Equipment in accordance with the applicable Incoterm and, to the extent applicable, building permits and operating permits. The Purchaser shall, at the Supplier’s request, assist the Supplier in obtaining (temporary ) import permits and/ or licenses for Supplier’s Erection Equipment, visa and/or work permit required in the Country for Supplier’s personnel and any further authorizations, consents and/or approvals necessary for the performance of this Contract in the Country.



卖方应在进度计划规定的时间限制内获取这些许可/证书或提供这些协助，如进度计划里无此时间限制，应在合理时间内提供并要把设备交付时间和安装及开车时间因素考虑到。

The Purchaser shall obtain such permits and licenses, or render such assistance within the time limits stated in the Time Schedule or, if not so stated, within reasonable time having regard to the time for delivery of the Equipment and the time for Erection and Start Up.



办理施工许可证及其他施工所需证件、批件和临时用地、停水、停电、中断道路交通、爆破作业等的申请批准手续（证明承包人自身资质的证件除外）；

Apply license for the construction and other certificates and approvals for construction (Certificates that prove aptitude of the contractor are excluded). Get approvals for temporary land use, cut-off of water supply, cut-off of power supply, intermission of traffic and blast practice.



办理施工许可证及其他施工所需证件、批件和临时用地、停水、停电、中断道路交通等的申请批准手续。

Get the Construction Permit, and other necessary approvals. Apply for temporary land—use rights. Obtain the authorizations to shut public power or water supply, shut down roads if necessary for the execution of the works.



负责协调有关各方面人员以确保顺利获取本工程所需要的许可证（如消防内装修建审意见等），以确保工程顺利开工。

To coordinate with all relevant parties in application for permits (e.g. comments on fire protection for interior decoration) necessary for the Project, to ensure timely commencement of work.



总包商应帮助分包商获得分包商雇员所需的入境签证、居住证和劳动证、该分包工程所需的施工材料和设备进口许可证，以及生活用房。办理这些函件所花的费用以及由此产生的一切开支均应由分包商承担。

General contractor should assist subcontractor available for entry visas, Permissions of residence and work, which are necessary for subcontractor’s employees, in addition to the import permission of materials / equipment needed by subject, as well as living house. All cost and expense arising therefrom shall be for subcontractor’s account.



合同期内，主管部门不能要求承包商获取合同规定以外的油气勘探开发许可及政府批准。主管部门应协助承包商获得必要的许可，包括但不仅限于土地使用权、特殊自然资源使用许可、哈萨克斯坦共和国紧急事务委员会以及其他必要许可。

During the Term of the Contract, the Contractor shall not be required to obtain any additional License, permission or sanction of the Government for the conduct of Exploration and Recovery of Hydrocarbon Raw Materials in the Contract Territory in accordance with the conditions of the present Contract. The Competent Body shall assist the Contractor in obtaining all necessary permissions and licenses, including, but not limited to, land concessions, permission to conduct special nature uses, permission of the State Committee of the Republic of Kazakstan for Emergencies and other necessary permissions and licenses.



作业许可证由各专业承包商安全员签发，经承包商项目经理审核确认，由JKPM和监理机构批准后方可实施。禁止未经许可就进入施工作业。

All PTW application will be issued by the safety personnel of the related contractor and will be confirmed by the Project manager from Contractor. Then it shall be reviewed and approved by JKPM and supervision organization. Commencement without approval is strictly forbidden.



开工前7日内，将施工许可证、道路、铁路、河流等通行权手续、临时占地、爆破等许可手续办理完毕。

Within seven days prior to commencement complete the procedures of Execution License, past rights of road, railroad and river in addition to permissions of temporary land use and explosion work.



N.公司应协助承包商，以确保承包商或其分包商的雇员及他们的家属获得和续签所有的入境签证或工作许可，以及在伊朗所需要的其他手续，此方面的协助为承包商在伊朗境内开展本合同项下义务所必需。

N.I.O.C shall provide assistance to Contractor in securing and renewing all entry or work permits for employees of Contractor or its subcontractors and their dependents as well as all other formalities in the IR of Iran for which the assistance of N.I.O.C is necessary to enable Contractor to carry out its obligations in IR of Iran under this Service Contract.



发包人取得的有关审批、核准和备案材料，如规划许可证。
